What is an Automatic Stay?

 

As of the date of filing of your case, an Automatic Stay (injunction) is in effect. This means that your creditors cannot call you or otherwise contact you about payment of your debts and cannot take any legal action against you outside of the Bankruptcy Court. Although this Automatic Stay is in effect as soon as your case is filed, it may be several weeks before the actual notice of the filing and the existence of the Automatic Stay will be sent to creditors. If you case has been filed and creditors are calling, you should tell them that you have filed for Chapter 7 bankruptcy and give the date your case was filed and your case number. If a creditor wants to verify the information, suggest to them that they contact the Clerk of the Bankruptcy Court at (888) 232-6814.
